These terms and conditions ("Terms") govern your use of NostalgiaBox ("the App"), provided to you by Aberash LLC ("the Company"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

1. License

1.1. Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

1.2. You may not:

  • Reverse engineer, decompile, or disassemble the App.
  • Use the App in a manner prohibited by law or infringing upon the rights of others.

2. User Content

2.1. The App may allow you to submit, upload, or post content, including but not limited to text, images, and videos ("User Content").

2.2. By submitting User Content, you grant the Company a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the App.

2.3. You represent and warrant that:

  • You own or have the necessary rights, licenses, and permissions to submit User Content.
  • Your User Content does not violate the rights of any third party, including copyright, trademark, privacy, publicity, or other proprietary rights.

3. Privacy

3.1. Your use of the App is subject to the Company's Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

4. Intellectual Property

4.1. The App and all content and materials contained therein, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the property of the Company or its licensors and are protected by copyright, trademark, and other intellectual property laws.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

6.1. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY OR ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.1. The Company reserves the right to modify or revise these Terms at any time by posting the updated Terms on the App. Your continued use of the App after the posting of any changes to these Terms constitutes your acceptance of such changes.
